Different Drugs, Different Charges
There are several distinct drug crimes with which you can be charged, including: Manufacturing; Trafficking; Delivery and Possession. Often defendants will be charged with more than one crime, and there may be room for negotiation with the district attorney. These crimes have different penalties and different levels of seriousness.
There is also a variety of penalties for crimes involving different illegal drugs such as methamphetamine (crystal meth), cocaine, crack cocaine and marijuana.
Prescription drug crimes are increasingly being prosecuted. Often the drugs are stolen or diverted from drugstores. Other people are charged with changing their prescriptions, or the drugs are imported illegally from Mexico. In the Houston area, drugs that are being targeted include Vicodin, Xanax (bars) Soma Aderall, Ritalin, and Oxycontin. Again, each drug and each charge come under unique laws.

Seeing if the Evidence Against You Is Legal
Not only are all criminal defendants innocent until proven guilty, the evidence for that proof needs to be obtained legally by the police and prosecutors. I am very knowledgeable in Criminal Procedure laws; therefore I will evaluate each case and incident to determine if proper Search and Seizure procedures were used by law enforcement. If there were search warrants for your home or car, I will obtain them to see if they were properly issued and signed.
If you were arrested for a drug crime in a traffic stop, I will examine the police report to look for probable cause for the stop. Racial profiling, driving in certain areas at particular times of night, and other arbitrary reasons are not probable cause. Often they will claim you committed a minor traffic violation like not using your turn signal. I will make sure you get a chance to tell your side of the story.
I will also examine any lab tests to determine whether the lab actually looked at the evidence and did the appropriate analysis.
