Dealing With Emergency Protective Orders and Possible Jail Time
There are several potential consequences of domestic violence charges. If the accuser files an emergency protective order against you, you will not be allowed to go within 200 feet of his/her house, even if it is your own house. Even if the alleged victim of the assault does not want an Emergency Protective Order, the State can file one against you anyway. If you are convicted of domestic violence for the first time, you may face jail time, depending on the specific accusations. If you already have one prior conviction for domestic violence, a second accusation will lead to automatic felony charges.

In the criminal justice system, all charges are brought by the state (the district attorney. Many people misunderstand this and mistakenly believe that the person making accusations about domestic violence has the ability to "drop the charges."
